HarborPay is a non-custodial software interface. We do NOT store, hold, or have access to your digital assets, Private Keys, or Recovery Phrases. You retain sole and exclusive control over your funds and cryptographic credentials. We cannot reverse transactions or recover lost credentials.

1.Acceptance of Terms

By downloading, accessing, or using the HarborPay application (the "App" or "Service"), provided by HarborPay ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2.Description of Service

HarborPay is a non-custodial digital wallet interface designed to enable users to:

The Service does not act as a broker, exchange, custodian, or financial institution. We do not execute trades or hold custody over user assets.

3.User Responsibilities & Key Management

  1. Safeguarding Recovery Phrases: You are strictly and solely responsible for backing up, maintaining, and securing your Recovery Phrase (Seed Phrase) and Private Keys. IF YOU LOSE YOUR RECOVERY PHRASE, WE CANNOT RECOVER IT OR RESTORE YOUR FUNDS.
  2. Transaction Verification: You must carefully verify recipient addresses, blockchain networks, gas fees, and token amounts prior to broadcasting any transaction. Transactions on blockchain networks are permanent and irreversible.
  3. Lawful Use: You agree not to use the Service for money laundering, terrorism financing, market manipulation, or any unlawful activity under applicable laws.

4.Third-Party Protocols & Swap Disclaimer

  1. The Swap function relies on third-party decentralized smart contracts and liquidity protocols. We do not control, own, or guarantee the operation, price accuracy, or availability of these external protocols.
  2. We are not responsible for transaction failures, network congestion, slippage losses, or smart contract vulnerabilities occurring during a swap.

5.Fees & Network Charges

Transactions broadcast via the Service require network fees ("Gas Fees") paid directly to the respective blockchain validators. We may charge a transparent interface fee for certain services (e.g., Swap routing), which will be disclosed prior to transaction execution.

6.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBORPAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DIGITAL ASSETS, PROFITS, OR DATA ARISING FROM NETWORK FAILURES, THIRD-PARTY HACKS, USER NEGLIGENCE, OR PROTOCOL ERRORS.

7.Apple App Store Supplementary Terms

These Terms supplement the Apple Standard End User License Agreement (Apple Standard EULA). In the event of a conflict between these Terms and the Apple EULA, these Terms shall govern with respect to the HarborPay Service.
